Industrial strategies are tailored to meet the requirements of each client, focusing particularly on the employee relations outcomes each client desires, and taking into account the industrial environment in which the client operates. All options are canvassed, and the pros and cons of each option reviewed, before the client makes a final decision as to the most appropriate option to be followed.
Once the appropriate option has been selected, support is provided in preparing documents such as Australian Workplace Agreements, negotiating enterprise agreements with employees and unions, and drafting agreements for certification by the relevant Industrial Relations Commission. A strong relationship with the Office of the Employment Advocate allows for pre-assessment of proposed AWAs to ensure acceptance of the AWA at the time of registration.
A key part of any industrial relations strategy is the communication process where employees are advised of the proposed changes. Advice and support is provided to line managers and human resources managers about appropriate ways to communicate changes in the workplace.
Ensuring managers know how to manage, and understand employees’ rights and obligations is a key part of the successful implementation of any industrial strategy. For example, training was provided to all employees at a leading supermarket in the vision and values of the company, EEO, OHS, interaction management, and communication styles. Managers also received training in setting standards, motivating staff, understanding their needs, managing conflict, managing performance, disciplinary processes and giving feedback.
Additionally, staff may also be trained in equal employment opportunity, bullying and harassment issues.
Enterprise Law also provides legal representation in a range of matters, including unfair dismissals, union rights of entry claims, dispute resolution and award coverage claims.
